About Joshua Bourne

Joshua R. Bourne is a dedicated San Diego criminal defense attorney who has more than two decades of experience advocating on behalf of the criminally accused. After graduating from law school, Mr. Bourne worked as a Deputy City Attorney in San Diego, prosecuting cases that arose within San Diego proper on behalf of the government. While here, Mr. Bourne spent much of his time in the Domestic Violence Unit, where he gained valuable insight into how DV crimes are prosecuted and what causes a prosecutor to doubt the strength of their case.

After leaving the City Attorney’s office, Mr. Bourne spent a short time with a large civil law firm, where he honed his negotiation and litigation skills. Once Mr. Bourne was confident he had acquired the understanding and skills needed to open up his own firm, he established the Law Office of Joshua R. Bourne.

Since the firm’s founding in 2006, the Law Office of Joshua R. What Is the California Three Strikes Law?

Enacted in 1994, the California Three Strikes Law is a criminal justice policy that was intended to reduce violent crime by imposing incredibly strict penalties on repeat offenders. Under the Three Strikes Law, any person with two prior convictions for serious or violent felonies would, upon committing a third felony, face a mandatory life sentence with the possibility of parole only after 25 years.

While many provisions of the Three Strikes Law have been stepped back in recent years, the framework is still in existence. As a result, those facing “serious” or “violent” felonies must consider not only the immediate impact of a conviction but also the effect that accruing a strike will have on their future.

What Crimes Count as “Strikes” in California?

Under California Penal Code 667, a strike is any conviction for a “serious” or “violent” felony. Examples of what constitutes a strike include the following:
